Each jurisdiction, whose main interest is the well-being of its citizens, must do its utmost to set up the necessary regulatory framework. Creating and ratifying the necessary legislation that ensures legal protection and a closely monitored market will always facilitate the safety of the citizens.

Online gambling is a sensitive part of the entertainment field that will always garner criticism and will necessitate tight regulations. Legal gambling can be kept under scrutiny and allows the authorities to direct their efforts in efficient directions rather than crack down on illegal gambling activities.

One of the most indicative examples of this course of action is the case of the relationship between online casinos UK and the British regulator, the UKGC. The Commission does a lot of efficient legislative reinforcement, overseeing aspects from licensing to how a simple no deposit bonus is presented to the player.

The UK’s online gambling legal landscape is particularly fascinating due to its decisive role in keeping things under control. This article will tackle what the situation looks like.

A Brief History of UK’s Gambling Regulations

Gambling has been a subject of interest for the British authorities for a very long time. While the advent of online gaming has prompted a new approach, the UK’s history with gambling legislation began a long time ago.

The first iteration of the Gambling Act was in 1845 and became the precedent that this activity would definitely benefit from well-set-up gambling rules. The primary measures featured in this legislation were the legalisation of these games, the outlawing of any form of cheating, and the legal enforcement of the validity of gambling contracts.

While other laws entered gambling-related legislation over the following decades, it was only with the rise of digital gaming that the authorities started considering a new legislative approach to this activity.

The 2005 Gambling Act – A Game Changer

As the iGaming market was a rising trend on the internet and gambling found a new avenue of expansion, the situation required a new set of regulations. As such, a comprehensive framework of online gaming laws became a necessity that the British government was ready to address.

The legislative result was the Gambling Act of 2005, which tackled both land-based and online games of luck. The main idea was to update the legal framework and ensure forms of protection for at-risk demographic categories, minimise illegal gambling, and others we will discuss further.

Since this new set of legislation required an entity to oversee and reinforce its applicability, the 2005 Act led to the creation of the United Kingdom’s Gambling Commission.

The Role of the UKGC

The UKGC is an authority that is directly subordinated to the British government’s Department for Digital, Culture, Media and Sport. Its main prerogatives are to review and license the commercial entities that wish to enter the UK market as gambling operators.

Overseeing and monitoring these activities makes the UKGC the necessary regulator that ensures customers are genuinely protected when playing games of luck.

Main Measures

The passing and implementation of this kind of legislative framework have clear objectives that try to maximise the protection of the playing citizen. With the introduction of the 2005 Act, several measures have been clearly taken place as the main takeaways of its introduction:

  • The clarification of the required objectives and standards for operators: This measure ensured that any gambling operator wishing to enter the British market must first follow strict operative guidelines.
  • Ensuring a controlled approach to advertisement, marketing, and gambling promotion: Since any promotional campaign can reach minors if not regulated properly, a set of guidelines in the field of advertisement is essential.
  • Measures for adequate player protection: Any gaming brand that wants to prove that it can provide legal online betting needs to satisfy the player protection requirements. This includes ensuring that minors and other vulnerable demographical categories don’t access games of luck. It also means safeguarding them from scammers and promoting safer gambling.
  • Reinforcing Fair Play: As long as a gambling brand requires its users to pay for its services, that operator needs to prove that its practices are fair and transparent.

Recent Legislative Shifts

Since the 12th of September 2022, the UKGC has started bolstering its rules roster. The outline of these measures would be that the Commission has started to evaluate the interactions between operators and at-risk players.

As gambling-related harm started getting noticed, there were more and more factors that help in protecting players and aiding them in a time-efficient manner.

Conclusion

As we’ve showcased in this article, the UKGC has a comprehensive and very well-set-up approach to gambling from a legislative point of view. Since playing games of luck can prove risky, the legislative emphasis on player protection does its utmost to uphold the principle that you should always gamble responsibly!
